Face Commissions: Terms of Service
By commissioning us (Monpattern), you (the customer) agree to our Website Terms of Service and Commissions Terms of Service:
OUR WEBSITE TERMS OF SERVICE. You must be 18+ years old to commission us.
Please note the terms on this page are applicable to private purchases and customized products only.
MonPattern terms:
- The commission will be created in our own style. We will do our best to match your reference images as closely as possible. Please see our prior works to see our own style before you commission us.
- We do not take commissions on a first-come, first-serve basis.
- We reserve the right to refuse any commission that we do not feel comfortable with. This may include technical issues with the subject or the content of the commission itself.
- In the case of commissioning an original character, you must own the character or have permission from the owner to have it made.
- We reserve the right to publish images of the finished face embroidery or work-in-progress (WIP) for promotional purposes. If the commission is a gift or requires confidentiality, please notify us in advance.
- We also reserve the right to sell or modify the embroidery files to create other designs at any time.
- We can accept requests to recreate faces we’ve made before at MonPattern. Since all files are handmade and tested on our embroidery machines, we cannot guarantee that the new file will stitch exactly the same. Colours, line thickness, and minor details may vary. We may also make improvements to the file if we believe it enhances the stitching quality or usability.
- We reserve the right to manage any incident or respond to messages and not attend to the customer in case of not addressing us as cordially as possible, that is, messages that contain any profanity, foul language, insults, threats and derogatory comments that do not favor the customer-store relationship.
Payment
- Price quotes are non-negotiable and valid for 3 months from the date issued.
- The price quote is based on the information and specifications provided at the time of the estimate. Any significant changes to the design, colors, expressions, or complexity of the face may result in a revised price.
- Price quotes do not include any additional taxes or VAT that may apply depending on the client’s location.
- For modifications of existing MonPattern designs, the quoted price always covers one size and one format only. If you need multiple sizes or formats, this must be requested when providing all the information for the commission.
- It is the client’s responsibility to provide the correct size and a format compatible with their embroidery machine. Once the commission has started, the size cannot be changed, as this would require creating a new commission.
- To reserve a face commission slot, full payment is required. If payment is not received, the slot may be offered to another client.
- Prices are listed in euros (€). Prices shown in US dollars ($) are approximate and may vary depending on the current exchange rate.
- Payments can be made via our online store using any of the available payment methods (credit/debit card, Shop Pay, PayPal, Google Pay, etc.).
- Work on your face commission will not begin until full payment has been received.
- Once payment is made, it is non-refundable. Commissions require reserving our time, and if cancelled, we cannot offer the slot to another client without losing time and resources. Please be sure before paying or confirming your commission.
Process terms:
- Our face commissions usually take around 1 month to complete once work begins. This timeframe can vary depending on the complexity of the design and the number of versions requested (for example, if extra tests or adjustments are needed). Please note that production time is an estimate and cannot be a reason for a refund.
- The customer must clearly specify their preferences (expressions, eye colors, scars, markings, etc.) when submitting the quote form. We reserve the right to add an extra charge for modifications not mentioned before payment.
- All custom face commissions are created in the specific size and format requested by the client, unless otherwise agreed. Unlike regular products, we do not provide the files in multiple sizes or formats by default.
- We design each face by considering the character’s overall style, expressions, and markings, as well as feasibility for embroidery. Please note that we may not always be able to replicate certain effects exactly if they are too detailed for embroidery.
- The face will be created based on the approved sketch, but small differences may occur in the final embroidery file due to technical limitations.
- Once your commission begins, we’ll send a sketch of the face for your approval. Minor tweaks can be requested at this stage.
- If requested changes differ significantly from the information originally provided in the quote form, additional charges may apply. Major modifications may be declined depending on the design complexity or available time.
- Once the sketch has been approved, no further modifications will be accepted as part of the original commission. Any request for changes or alterations made after approval will be considered a new request and will require a new price quote. Acceptance of such requests is not guaranteed and will depend on availability, workload, and design feasibility at the time of the request.
- If the customer does not respond within 7 days of receiving the face sketch, the design will be considered approved and we will proceed with creating the embroidery file.
- We will assign thread colors in the design that are similar to your reference. However, it is your responsibility to select the exact thread colors you want to use when embroidering, to ensure they match your character as closely as possible.
- It is the customer’s responsibility to review the sketches carefully and communicate any concerns or requested changes within the given timeframe. Once approved or the approval period passes, we are not responsible for any issues caused by uncommunicated preferences or missed details.
- We cannot guarantee exact completion dates, but if you have a deadline, please let us know and we’ll tell you if it is possible. We will not prioritize a commission over previously scheduled ones to meet a deadline given after the commission was accepted.
Exchanges, Returns & Refunds Policy
- The purchase of a customized product is considered an outright purchase. The order cannot be canceled, exchanged or refunded under any circumstances. We remind our customers that they must be totally sure of their purchase.
- We reserve the right to cancel or deny your customized product for any reason. A full refund will be issued in this circumstance.
Delivery
- Once your face commission is finished, you’ll receive an email with a download link to your embroidery files.
- The download will be available through our digital products system, allowing you to access it directly from your account on our website.
- We do not send files directly via email. All downloads are provided through our website.
- All embroidery files are thoroughly tested before delivery on our own embroidery machines. Tests are performed using PFAFF embroidery machines and minky fabric to ensure the files stitch out correctly.
- Files are delivered fully tested and reviewed to avoid technical errors in the design itself. However, MonPattern cannot be held responsible for embroidery results that differ due to external factors beyond our control, including but not limited to the customer’s machine model, machine settings, hoop size, fabric type, stabilizer, thread, needle, or tension adjustments.
- Due to differences between embroidery machines, materials, and individual settings, the final embroidery result may vary from one setup to another. It is the customer’s responsibility to perform test stitches and make any necessary adjustments on their own machine.
- MonPattern delivers only the embroidery file format selected by the customer at the time of purchase (such as VP3, PES, etc.). The original editable EMB working file is not included and will not be provided under any circumstances.
- It is the customer’s responsibility to download and safely store the files. Downloads will typically remain available for several months. After that, MonPattern is not responsible if the download is no longer accessible. However, you may contact us to request reactivation of the files if needed.
- Any embroidery files, sketches, and other materials created for your face commission remain the property of MonPattern. You may use them to create plushes for personal use or to sell finished plushes, but you may not sell, share, or distribute the files or sketches themselves.
- We are not responsible for technical issues on the customer’s device, email, or internet connection that may prevent access to the files or our messages.
- It is strongly recommended to download and back up the files immediately after receiving the link to avoid any issues.
- We not provide technical support related to embroidery machine setup, materials, or stitching adjustments after file delivery.
- Altering, resizing, or modifying the embroidery files after delivery may affect stitch quality. MonPattern is not responsible for issues resulting from file modifications made by the customer or third parties.
- If the customer later decides to request changes or alterations to the delivered design or files, these will be considered a new request and will require a new price quote. Acceptance of such modification requests is not guaranteed and will depend on availability, workload, and design feasibility at the time of the request. MonPattern reserves the right to decline modification requests that fall outside the original scope of the commission or that cannot be accommodated due to time or technical constraints.
