Plush Commissions: Terms of Service

By commissioning us (Monpattern), you (the customer) agree to our Website Terms of Service and Commissions Terms of Service:

OUR WEBSITE TERMS OF SERVICE. You must be 18+ years old to commission us.
Please note the terms on this page are applicable to private purchases and
customized products only.

MonPattern terms:

- The commission will be created in our own style. We will do our best to match your reference images as closely as possible. Please see our prior works to see our own style before you commission us.

- We do not take commissions on a first-come, first-serve basis.

- All plushies include a sewn-in tag with our logo.

- We reserve the right to refuse any commission that we do not feel comfortable with. This may include technical issues with the subject or the content of the commission itself.

- In the case of commissioning an original character, you must own the character or have permission from the owner to have it made.

- We reserve the right to publish photos of the finished plush or work-in-progress (WIP) images for promotional purposes. If the plush is a gift or requires confidentiality, please notify us in advance.

- Any patterns, embroidery files and other materials created or used for your plush will remain the property of MonPattern. Even if you commissioned an original character, this will not give you the right to claim the patterns for free in the future.

- We reserve the right to sell patterns created or used on a commission at any time.

- We reserve the right to repeat a commission anytime, either as a commission or just to sell it. Only in the case of original characters will they be exclusive to the person who commissioned them.

- We reserve the right to manage any incident or respond to messages and not attend to the customer in case of not addressing us as cordially as possible, that is, messages that contain any profanity, foul language, insults, threats and derogatory comments that do not favor the customer-store relationship.

Payment

- Price quotes are non-negotiable and valid for 3 months from the date issued.

- The price quote is based on the information and specifications provided at the time of the estimate. Any significant changes to the design, materials, size or complexity of the commission may result in a revised price.

- Price quotes do not include any additional taxes, customs duties or VAT that may apply depending on the destination country or platform.

- If the 3-month validity period expires, the price quote will no longer be valid due to potential changes in material costs and labour rates. In that case, a new estimate may be required.

- A 30% non-refundable deposit is required to reserve your commission slot. Clients also have the option to pay the full amount upfront if they prefer.

- Prices are listed in euros (€) and include shipping unless stated otherwise.

- Prices shown in US dollars ($) are approximate and may vary depending on the current exchange rate.

- Payments can be made via PayPal or Shopify Payments (credit/debit card, Shop Pay, Google Pay, etc.).

- After receiving the slot confirmation email, clients must pay either the 30% deposit or the full amount to secure their slot. Any remaining balance can be paid at any time up until the payment deadline, which will be set a few weeks before the scheduled slot begins and specified in the confirmation email.

- Work on your commission will not begin until the full payment has been received by the specified deadline.

- If the full payment is not completed by the deadline, the commission slot may be cancelled without further notice and offered to another client. In such cases, the 30% deposit will not be refunded.

- In case the client decides to cancel before their commission slot begins, the 30% deposit is non-refundable.

- Once the commission work has officially begun, no cancellations or refunds will be accepted under any circumstances.

Process terms:

- Our commissions take 3-4 months to complete once the plush is started. The production time is an estimate and will never be a motive for a refund.

- The customer must be clear and specify the preferences they have for their commission when sending the quote form. We reserve the right to add an extra charge to any design modifications not mentioned before the payment.

- We choose materials by considering the character’s overall atmosphere, the textures suggested by the illustration, and the silhouette. We also take into account production feasibility and balance. Please note that we may not always be able to use specific fabrics or materials requested.

- The plush will be created based on the approved sketch, but the final result may differ slightly as production progresses.

- For plushies with movable parts, the range of motion may vary depending on the costume design.

- Once your commission slot begins, you will receive a sketch of the outfit and hairstyle to confirm the design and color choices. At this stage, you may request minor changes if needed.
If the requested changes differ significantly from the information originally provided in the quote form, additional charges may apply. However, we reserve the right to refuse major modifications depending on the complexity or available time within your assigned slot.
After the design is approved, no further changes will be accepted.

- The face design will be sent to the customer prior to embroidery. Any changes to the design must be clarified at that time. Once the design is confirmed, it cannot be modified.

- If the customer does not respond within 5 days of receiving any design sketch (face, outfit or hairstyle), the design will be considered approved and we will proceed with production based on that sketch.

- A second sketch of the design will be made only if a large part of the sketch needs to be modified. Simple changes will be accepted without a new sketch.

- The fabrics with the closest color to the reference will be used. Please note that colors may vary depending on your monitor. Please be specific about the colors you want in your commission (both with images and in writing) so that there is no confusion, since it cannot be a reason for return.

- Please note that we work on several projects at the same time, so there may be weeks when we do not send updates. You can also ask us about the process of your plush via email.

- We cannot guarantee completion dates, but if you have a specific deadline, please let us know and we will tell you if it is possible. We will not move a commission up in our schedule to meet a deadline that was given after the agreement.

- It is the customer’s responsibility to carefully review all sketches and communicate any changes or concerns within the given timeframe. Once the approval period has passed or the design is approved, we are not responsible for any issues arising from uncommunicated preferences or missed details.

- Purchasing our plush for the sole intent of re-selling it is not allowed. You may display and use your plush for non-commercial purposes only. If we become aware that a customer has re-sold one of our plushies, we will no longer accept future orders from them.

Exchanges, Returns & Refunds Policy

- The purchase of a customized product is considered an outright purchase. The order cannot be canceled, exchanged or refunded under any circumstances. We remind our customers that they must be totally sure of their purchase.

- We reserve the right to cancel or deny your customized product for any reason. A full refund will be issued in this circumstance.

Shipping

- Shipping is registered, so the customer will receive a tracking number. The shipping price does not include, if any, customs clearance fees, destination country taxes or similar charges.

- Plushies are shipped in a box to prevent crushing or deformation during transit. The box is wrapped in a waterproof plastic bag to protect it from moisture.

- Shipments are made from Spain. Please keep in mind that external factors such as delays by the shipping service or couriers, logistical problems, holidays, customs, adverse weather conditions or the impossibility of accessing the indicated address may influence the punctuality of delivery.

- Shipments have two delivery attempts at home. It is important that you attach a telephone number so that the courier company can contact the customer in case of absence or failure to find the address. More information.

- If any issue occurs upon receipt of the package (for example, if the box or contents are damaged), the customer must report it to the shipping company within 24 hours of delivery. It is important to take photos of the package and contents, and to keep the shipping label as proof. Please note that we are not responsible for damages during shipping, as these are handled by the shipping company. We will provide any necessary documentation to assist the customer in filing a claim.

- If the package is not received within a reasonable timeframe, the customer must contact the shipping company to file a claim. The customer can submit a claim for non-receipt of the order within 6 months from the shipment date, as Correos Spain keeps the tracking number active for that period. After 6 months, tracking will no longer be possible, and we will not be able to provide assistance.

- Shipping is normally handled through Correos (Spain’s national postal service). If Correos is unable to deliver the shipment to the client’s destination due to service suspensions, restrictions, or other circumstances beyond our control, we will choose the next most economical alternative. In such cases, the client will be responsible for covering any additional shipping costs beyond the amount originally included in the quote.

Cleaning and care

- We make handmade collectible plushies, not toys. This is a completely handmade product, so it is not as durable as factory-made items.

- Our products include handmade elements, so they are not meant for rough treatment.

- Handle your plush gently, especially around delicate or movable parts.

- Store your plush upright or in a way that prevents crushing or deformation.

- It can be cleaned by hand with a damp cloth, gently and carefully. It should never be cleaned with a washing machine or in any rough way.

- We are not responsible for any kind of damage that the plush may suffer once received by the customer.

- We do not offer maintenance, cleaning or repair services for plushies.

- Avoid using harsh chemicals or cleaning products on your plush, as they may cause discoloration or damage.

- Some plushies may include makeup details (such as blush, shading, etc.) applied with fabric-safe materials. These are not permanent and may fade or come off if cleaned or rubbed. Please take this into account before attempting to clean the face or body.

- Some designs may also include rigid decorative elements, such as jewelry, buttons, chains, or other miniature accessories. These elements are part of the plush’s design and are not intended for constant skin contact or sleeping. If you are planning to sleep with your plushie or handle it frequently, please let us know in advance so we can adapt the design and avoid rigid or fragile parts where possible.
